Kenyan High Court deems Nnamdi Kanu’s 2021 transfer to Nigeria unlawful and unconstitutional.
On June 27, 2025, a Kenyan High Court ruled that the rendition of IPOB leader Nnamdi Kanu from Nairobi to Nigeria in 2021 was “unlawful, unconstitutional” and violated his fundamental human rights under the Kenyan Bill of Rights.
Justice E.C. Mwita found the Kenyan government failed in its duty to protect Kanu after he entered the country lawfully, colluding in a covert operation with foreign agents that led to his detention and forced transfer.
The ruling condemned his incommunicado confinement, alleged torture, denial of legal access, food and water—deeming these actions as serious breaches of both domestic and international human rights obligations.
The decision could have major repercussions for cross-border law enforcement cooperation in Africa and revive broader questions on due process and state sovereignty in human rights cases.
