Kenyan court deems Nnamdi Kanu’s rendition to Nigeria unlawful, cites human rights violations
A Kenyan High Court today ruled that the 2021 rendition of Indigenous People of Biafra (IPOB) leader Nnamdi Kanu from Nairobi to Nigeria was unlawful and violated his fundamental rights under Kenyan law.
Justice E.C. Mwita found that Kenyan authorities failed to safeguard Kanu’s constitutional rights, and that INTERPOL improperly enabled illegal extradition. The court asserted that Kenya should have detained and protected him, not facilitate rendition.
The ruling criticizes both state actors and international policing frameworks for sidelining judicial processes in cross-border detentions. Kanu’s legal team welcomed the verdict as a milestone for due process.
This precedent could impact future rendition cases in Africa and reinforce protections against extrajudicial abductions, potentially prompting diplomatic reviews between Nigeria and Kenya.
